Keberpihakan Masyarakat Asli, Australia Salut Bas

Gubernur Provinsi Papua, Barnabas Suebu SH saat mendapat ucapan selamat dari Profesor Emeritus Merv Hyde Am PhD.BRISBANE—Profesor Emeritus Merv Hyde Am PhD, Direktur Akademik Internasional Projects Group School of Science and Education dari Unversitas Sunshine Coast, Quensland, Australia, mengaku salut dengan pemikiran-pemikiran briliant Gubernur Provinsi Papua, Barbanas Suebu SH, atas upayanya memproteksi hak-hak dasar masyarakat asli Papua.  “Kami harus banyak belajar dari Papua, Pak Gubernur (Barnabas Suebu), anda punya tanah sendiri dan bisa mengendalikan hak-hak orang asli Papua, anda bisa memelihara hutan anda, anda termasuk masyarakat yang paling bahagia di muka Bumi ini,” ungkap Merv Hyde saat jamuan makan siang di Under Water Wold, Mooloobala, Brisbane, Selasa (19/4) kemarin.  Dalam kesempatan tersebut, Prof Merv Hyde juga mengungkapkan, bahwa proteksi dan  pemberdayaan terhadap masyarakat asli yang dilakukan Gubernur Papua  terhadap masyarakat Papua, selain telah banyak menginspirasi pemerintah di negara-negara maju, pemikiran Bas (panggilan akrab Gubernur), juga telah merupakan tamparan bagi negara-negara maju untuk segera mengambil langkah proteksi terhadap masyarakat asli.

“Anda (Gubernur) adalah seorang anak yang datang dari kampung kecil, kinerja anda sudah pernah menghias halaman majalan Times, pemikiran-pemikiran anda telah banyak membantu kami untuk bertindak, pemikiran Anda bukan lagi domestik tapi Internasional,” ungkapnya.

Selaku negara yang menjalin hubungan harmonis dengan Indonesia, ungkapnya, perhatian pemerintah Australia cukup besar ke Indonesia. Papua merupakan bagian yang tidak lepas dari perhatian pemerintah Australia. Kebijakan pembangunan terutama pembangunan di wilayah Papua selalu menarik untuk dilihat.

Kami, sambungnya, terutama pihak Universitas of the Sunshine Soast, memiliki sejumlah projek penelitian tentang Papua, dan sejauh yang pelajari, beliau (bas) termasuk pemimpin dari masyarakat asli Papua yang mampu membawa perubahan mendasar bagi masyarakatnya.

“Gelar Doktor (Am Phd) dari pihak Universitas kepada beliau (Bas) sudah melalui kajian academic yang bisa dipertanggungjawabkan, beliau termasuk sedikit dari sekian banyak anak-anak Papua yang patut mendapat kehormatan tersebut,” ungkapnya.

Universitas of the Sunshine Coast merupakan universitas ternama di Negara Bagian Quensland Asutralia, Universitas ini juga merupakan universitas terbaik yang projecknya diakui telah membangun perekonomian satu wilayah yang dulunya terbelakang dari segi ekonomi kini menjadi wilayah yang mampu menghidupi masyarakatnya.

Gara-gara Pikiran Besarnya, Bas Dinobatkan Gelar Doktor Sementara itu, kritikan-kritikan miring  dari berbagai kalangan menghantam Barnabas Suebu, namun kinerja dan upaya Gubernur Provinsi Papua, Barnabas Suebu SH, untuk membangun orang kecil di kampung-kampung, diam-diam telah mendapat perhatian kalangan akademik di tingkat Internasional.

Barnabas Suebue SH, yang notabene adalah anak kampung ini, direncanakan akan dinobatkan dalam satu upacara resmi seb agai doktor yang dilakukan Universitas of the Sushine Coast, di Quoensland, Brisbane, Australia, Rabu (20/4).

Penobatan Bas ini, didasarkan lewat program primadonanya yakni Rencana Strategis Pembangunan Kampung (RESPEK) yang diyakini melalui kajian akademik telah banyak membawa perubahan bagi masyarakat Papua. Penobatan Bas ini juga mendapat perhatian dari kalangan akademisi di Papua, turut hadir dalam penobatan tersebut, rektor UNCEN dan UNIPA juga hadir. Seperti Prof. Dr. Bert Kambuaya dan Ir. Yan Piet Karafir M.Si., yang adalah rektor UNCEN Jayapura Papua dan UNIPA Manokwari Papua Barat. “Walaupun apa yang dilakukan Gubernur Barnabas Suebu melalui RESPEK baru berjalan empat tahun, namun capaian sudah menjawab perhatian masyarakat dunia,” jelas Profesor Emeritus Merv Hyde Am PhD, Academic Direktur Internasional Projecks Group School of Science and Education dari Unversitas Sunshine Coast, Quensland, Australia.(hen/don)

West Papua to lobby against Indonesia observer status

INDONESIA should not become a member of Melanesian Spearhead Group, MSG, says the mission head of the West Papua National Coalition for  Liberation based in Vanuatu Andy Yamiseba

Mr Yamiseba said that if the Indonesia could become an observer then Australia could also as there are Melanesians living on islands in the Torres Straight

He said that the demand for Indonesia to gain observer status will see his organisation lobby  Vanuatu, Papua New Guinea, Fiji, Solomon Islands and the FLNKS of New Caledonia to oppose the plan.

He believes that at least Vanuatu and the Solomon Islands will reject the plan for Indonesia to be come an observer nation.

Mr Yamiseba said he hoped to met with Solomon Islands Prime Minister Dany Philip, who was currently in Port Vila this week to attend  the European Meeting on Climate Change.

He said as long as Prime Minister Michael Somare was in power in Papua New Guinea, he did not believe PNG would support Indonesia.

Mr Yamiseba said that if the MSG leaders granted observer status to Jakarta, it will defeat the progress that has been already taken place.

Last year the Vanuatu Parliament unanimously approved a statement in support of West Papua issue and there have been widespread calls in Vanuatu for West Papua to gain observer status with the MSG.

DPRD Berang, Tanah Adat Dihargai Rp 384 per Meter

Ketua DPRD: Kami Akan Segera Bentuk Tim Khusus Mengkaji Besaran “Tali Asih” yang Dibayarkan PT. TSP

Keerom–Mencuatnya nilai besaran pembayaran ganti rugi tanah Adat oleh PT Tandan Sawit Papua (TSP) kepada 8 kereth di wilayah Distrik Arso Timur, yang berdasarkan hasil penelusuran wartawan koran ini jauh dari nilai yang layak, membuat Ketua DPRD Keerom, berang.  Terkait itu, DPRD Kabupaten Keerom dalam waktu dekat ini akan membentuk Tim Khusus untuk mengkaji lebih lanjut tentang nilai ganti rugi yang diberikan oleh PT TSP kepada 8 kereth di wilayah Distrik Arso Timur  tersebut. “Wah, tidak benar itu, keterlaluan, kalau memang seperti itu, kami akan kaji lebih lanjut dan segera membentuk Tim Khusus untuk mengkaji ulang, walau mereka bilang itu hasil kesepakatan dengan masyarakat tapi harus yang wajar ka!,” kata Ketua DPRD Keerom Isack Yunam kepada Bintang Papua via telepon Selasa (29/3) kemarin yang mangku tengah beristirahat di rumah karena masih dalam keadaan sakit.  Menurutnya lagi, sepengetahuannya secara pribadi maupun institusi proses dan besaran ganti rugi atas kesepakatan bersama antara masyarakat dan perusahaan, namun dia tidak mengetahui secara rinci berapa besaran ganti rugi yang diterima oleh masyarakat.

“Setahu saya itu sudah kesepakatan antara masyarakat dan perusahaan, posisi kita nantinya memastikan dan mengawasi masyarakat memiliki nilai tawar yang sama dengan perusahaan dalam menentukan nilai kontrak atau sewa tanah selama 35 tahun ke depan, karena itu tanah produktif,” katanya bernada berang.

Sebagaimana temuan harian Bintang Papua saat proses pembayaran ganti rugi hak ulayat 8 kereth di Distrik Arso Timur Jumat (25/3) lalu, dimana untuk total 18.337 hektar hak ulayat yang dilepas oleh masyarakat adat 8 kereth, kompensasi atau ganti rugi yang diberikan kepada masyarakat adat hanya sebesar Rp. 7 Milyard lebih sedikit, dan rencananya tanah ulayat tersebut akan di sertifikatkan dengan status Hak Guna Usaha (HGU) untuk dijaminkan ke Bank sehingga perusahaan memperoleh pembiayaan untuk kelangsungan pengembangan perkebunan kelapa sawit tersebut.

Dengan nilai kompensasi sebesar Rp. 7.040.000.000 untuk areal seluas 18.337 hektar, itu berarti per hektarnya tanah adat masyarakat yang menjadi sumber penghidupan masyarakat Arso Timur dan anak cucunya hanya di hargai Rp 384 ribu, artinya per meter tanah ulayat tersebut hanya di hargai Rp 384 rupiah.

Selain itu kejanggalan lainnya yang ditemukan Bintang Papua dalam proses pembayaran ganti rugi adalah lamanya proses pembayaran yang dilakukan dalam 4 tahap (4 tahun) padahal bila merujuk pada Peraturan Menteri Pertanian (Permentan) Nomor 26 Tahun 2007 Pasal 34 huruf a perusahaan perkebunan yang telah memiliki Izin Usaha Perkebunan (IUP) Budidaya maupun Pengolahan dan hendak mengurus Hak Guna Usaha (HGU) wajib menyelesaikan hak atas tanah kepada masyarakat selambat – lambatnya 2 (dua) tahun sejak diterbitkannya izin dimaksud, dan dalam peraturan perundang – undangan yang ada tidak dikenal istilah “tali kasih’ dan sebagainya namun yang diakui adalah ‘hak atas tanah ulayat”.(amr/don/03)

FKMPT Tolak Ormas Islam Non Papua

JAYAPURA—Forum Komunikasi Muslim Pegunungan Tengah (FKMPT) Papua menolak tegas Ormas Islam non Papua intervensi wilayah privaci Orang Asli Papua, dalam merekomendasikan, mengusulkan dan menetapkan Calon anggota MRP unsur  Agama Islam. Demikian  disampaikan FKMPT Papua yang ditandatangai Ketua Bidang Dakwah Adnan Yelipele dan Wakil Sekjen Yudo Asso melalui Siaran Pers kepada Bintang Papua semalam.  Siaran Pers  Calon Tetap Anggota MRP Unsur Islam  ini disampaikan kepada Gubernur Provinsi Papua Barnabas Suebu SH dengan tembusan dikirim kepada Presiden RI, Menteri Dalam Negeri,  DPR RI, Menkopulhukam,  Dirjen Otda Depdagri, DPR Papua, KOMWILPIL MRP, Pansus MRP, Kapolda Papua, Pangdam XVII Cenderawasih serta Ormas Ormas Islam. Dikatakan, sehubungan dengan ini FKMPT Papua menyampaikan penyelenggara rekruitman anggota MRP (Kesbangpol) Papua bahwa yang berhak berbicara tentang presentase kultural Papua adalah lembaga-lembaga Adat, Perempuan dan Agama Orang Asli Papua, maka FKMPT menyampaikan.

Pertama, menolak tegas Ormas Islam non Papua Intervensi Wilayah Privaci Orang Asli Papua dalam merekomendasikan, mengusulkan dan menetapkan Calon anggota MRP unsure  Agama Islam

Kedua, menganggap Tim 7 Ormas Islam / MUI, NU, Muhammadiyah Partai Politik Islam tidak legitimed tanpa melibatkan Ormas Islam Pribumi FKMPT

Ketiga, menganggap Komwikpil, Panwas Tim 7 Ormas Islam telah melanggar Konstitusi, karena menggunakan acuan UU Perdasus Pra Revisi Mendagri Tahun 2011 dan hukum Adat Papua.

Keempat, karena itu FKMPT desak Panitia Penyelenggaraan (Komwilpil dan Panwas Kesbangpol menggunakan acuan UU Perdasus MRP Revisi Mendagri).

Kelima, menolak tegas Rekomendasi Tim 7 Ormas Islam, karena bukan Ormas Islam Pribumi / FKMPT dan mohon dikembalikan kepada kami sebagai Ormas Islam Pribumi.

Dengan demikian, katanya,  tujuan baik dan mulia Pemerintah Pusat melalui UU OTSUS NO.21 tahun 2001 dan PP No 54 membentuk MRP adalah perlindungan, pemelihara dan pengembangan Orang Asli Papua serta untuk meningkatkan harkat martabat Adat, Agama, kepercayaan Orang Asli Papua.

Maka Keanggotaan MRP harus dikembalikan pada Filosofi tujuan pembentukan MRP. Maka yang mempunyai hak merekomendasikan adalah orang adat Papua dan Agama orang Asli Papua. Dalam hal perwakilan MRP unsure agama Islam Papua Ormas Islam non pribumi, orang politik tidak memiliki hak sama sekali merekomendasikan MRP. Maka KOMWILPIL dan Kesbangpol sebagai penyelenggara rekruitman Anggota MRP tidak boleh membiarkan campur tangan Ormas non Papua dalam rekruitman anggota MRP disalahgunakan politik mereka.

Menyikapi hal ini  rapat terakhir Pansus -MRP DPRP di Hotel Muspaco memberikan dukungan penuh kepada FKMPT Papua sebagai Ormas Islam Pribumi yang berhak secara mutlak merekomendasikan siapa yang layak jadi Anggota MRP. Maka FKMPT menetapkan calon anggota MRP unsure agama Islam adalah:  Ismail Asso dan Asri Yelipele

Berdasarkan pertimbangan tersebut FKMPT usulkan nama ini dan diluar nama ini Penyelenggara MRP dan Komwilpil harus membatalkan semua rekomendasi Ormas Islam non pribumi Papua. (mdc/don/03)

Island sold to foreigners - Island of New Hanover sold for K4 million

THE entire Island of New Hanover in New Ireland Province has been sold to foreigners for US$1.6million (K4m) in what has been described as the biggest scandal in the country’s short history.

Documents obtained by Post-Courier clearly give details of the sale, entered between Tutuman Development Ltd (seller) and a Singaporean Company identified as Palma Hacienda Ltd (buyer) in June 2009. The documents are the Sale and Purchase Agreement and a Supplementary Agreement entered between the two parties.

The deal to sell the island by Tutuman Development Limited whose directors include a former premier of the province and the foreign company was done without the consent of any authority from the landowners

Documents show the purchase price was paid into a director‘s personal bank account with the Citibank Singapore Ltd.

Ishmael Passingan, who is the company secretary for Central New Hanover Ltd, a landowner company, confirmed to this paper in an interview yesterday from New Ireland that the landowners became aware of the sale and the matter was reported to police on February 25 this year.
Police contacted confirmed that two days later on Monday February 27, 2011, investigators and detectives from the major organised crime unit detained one of the foreigners involved at the Jackson’s Airport and seized her passport when she was trying to leave the country.

Mr Passingan and the law firm representing the landowners, Titus Lawyers, confirmed Tutuman Development Ltd sold Portion 887C (Central New Hanover) together with Portions 885C (Umbukul) and 886C (Tabut) which make up the whole Island.

Documents also confirmed the former premier was at that time, the chairman of the company when the customary land were sold to the foreign company.

“We are now asking police to act swiftly to prosecute those implicated in the sale of the island and intervention from the National Government and the provincial government to return the birth rights of the people of New Hanover,” Mr Passingan pleaded.

Under the Supplementary Agreement to the Sales and Purchase the buyer was obliged to remunerate the seller an additional amount of $US1,000,000.

A deposit of $US200,000 (K600,000) was paid immediately upon the signing the agreement and the balance of K800,000 within six months from the date the agreement was signed.

AWPA calls on PM to raise concerns about death threat to human rights defenders with Indonesian President

AWPA  is calling on Julia Gillard to raise the threat to human rights defenders in West Papua with President  Yudhoyono.     Joe Collins of AWPA  said both Julia Gillard and President Obama had just been in  Jakarta and neither  raised concerns about the human rights situation in West Papua with the Indonesian President although  they knew about the video footage of the torture of Papuans which caused outrage around the world.  

Joe Collins said "they seem to want to treat the video evidence as if it is an isolated incident but in further evidence of  human rights abuses the most recent  leaked document  shows a list   of West Papuans engaged in human rights work are a target of the Indonesian Special Force Group, Kopassus, which holds military exercises with the Australian military". 

The leaked  document shows a list of West Papuans  who are supposed to be involved with so called separatists. The list includes members of civil society organisations, church groups , activists, students and  members of the Papua People Assembly (MRP). 

 Joe Collins said " there is a systematic campaign to intimidate both   human rights defenders  and  the West Papuan peoples a whole . It is well known the the Military regularly conduct  military operations in the highlands and evidence has come to light of the recent burning of the village of Bigiragi in the Puncak Jaya Regency.    These operations leave the local people traumatized and in fear for their lives.  If the Australian Government really believes that progress is being made in Indonesia to improve  human rights, why don't they send a fact finding mission to West Papua and listen to what the West Papuan people have to say."

Status Politik Papua di PBB Diperingati

JAYAPURA—Tanggal 19 November 1969 dikenal  sebagai tahun dimana sejarah Tanah Papua di perdebatkan di PBB dan Internasional. Untuk Papua tanggal 19 November 2010 dianggap ‘keramat’ oleh  sejumlah elemen elemen perjuangan Papua Merdeka   yang sejak  Jumat pagi, (19/11) bersama  kelompok Petapa atau penjaga Tanah Papua kembali mengenang saat dimana sejarah Papua diangkat dalam kongres Amerika.

Adanya  lampu hijau tentang agenda Papua yang dibicarakan dalam kongres Amerika, meski tak jelas  apakah kongres Amerika secara terang- terangan mendukung kedaulatan  Papua sebagai suatu   nega­ra atau tidak, tidak diterangkan secara  jelas.

Koordinator Umum aksi demo damai sosialisasi Congress Of the United State House Of Representatives Washington DC 20313 Wilson Waimbo Uruwaya  menyatakan rencana mereka  itu di kantor MRP kemarin,   dia bersama semua elemen perjuangan Papua yang ada di Jayapura akan melakukan demo ke DPRP  dengan satu tujuan mendukung semua alternatif/ solusi terbaik penyelesaian damai masalah status Politik Papua Barat tahun 1969 yang diperebatkan dalam sidang Umum PBB 1969 dan dinyatakan sebagai” Satatus Politik Papua yang Mengambang di PBB dan Internasional.

Menurut keterangan Wilson Uruwaya, semua elemen perjuangan rakyat Papua telah bersatu untuk mensosialisasikan hasil kongres Amerika  yang baru  berakhir 22 September 2010 telah diadakan acara dengar pendapat di kongres tentang kejahatan terhadap kemanusiaan oleh Sub Komite Asia Pasifik dan lingkungan global untuk mencarikan solusi dalam mengatasi masalah serta situasi sulit yang dihadapi Bangsa Papua Barat hari hari terakhir ini.

Dalam  kutipan laporan kongres Amerika yang tertulis, saat ini untuk pertama kalinya dalam kongres, pelanggaran hak asasi manusia yang terjadi di Papua Barat menjadi sorotan utama yang menyebabkan Bangsa Papua mendekati titik hasil dalam sejarah.

Dengan adanya Pelanggaran hak asasi manusia yang terjadi begitu lama dan panjang di Papua Barat, perlu mendapatkan perhatian dan pengakuan pihak Internasional dan penghargaan terhadap hak hak  orang Papua Barat.

Surat khusus kongres Amerika yang ditanda tangani Sheila Jackson Lee dari Congreess Women yang ditujukan kepada Profesor Kurtz dari Universitas George Mason bersama Herman Wanggai yang telah memasukkan Sheila Jackson Lee dalam kongres Amerika. Konon Sheila Jackson Lee adalah seorang perempuan Politisi dari Partai Demokrat Amerika yang memasukkan Barak Obama dalam  barisan Partai Demokrat Amerika dan berhasil meloloskannya dalam pencalonan Presiden Amerika.

Isu- isu tersebut diagendakan dan harus diusahakan jalan keluarnya, karena telah mengabaikan Papua Barat. “ Ini adalah harapan saya yang tulus bahwa harus ada upaya hentikan tindakan Militer Indonesia dan Pemerintah yang tidak adil, keadaan ini harus direformasi terhadap pelanggaran pelanggaran itu”.  Secara khusus kami mau harus ada peningkatan kesadaran untuk nasib orang Papua Barat dalam hubungannya dengan kelambanan aktor Internasional, maka situasi disana akan kian memburuk sebab bagaimanapun, sejarah Papua Barat berhubungan dengan Amerika Serikat.

Mengutip peryataan Sheila Jackson Lee dalam kongres tersebut, yang terungkap bahwa sesudah konferensi tersebut, pihaknya masih akan bertemu lagi dalam waktu dekat untuk bekerja sama dengan pihak keamanan Internasional agar mengamankan Papua Barat.  (Ven )

Disirkumsisi Sangat Epektif Mencegah Penularan HIV/AIDS

JAYAPURA [PAPOS]- Menurut Survei Terpadu HIV dan Perilaku [STHP] Papua tahun 2006 yang dilaksanakan Badan Pusat Statistik bekerjasama dengan Departemen Kesehatan Republik Indonesia dengan dukungan dana dari Bank Dunia dan Family Health Internasional besar angka infeksi [prevalensi] HIV pada penduduk di Tanah Papua sebesar 2,4 persen. Angka ini lebih tinggi dibandingkan penduduk lain di wilayah Papua.

Demikian disampaikan Ketua Pelaksana Harian Komisi Penanggulangan AIDS (KPA) Provinsi Papua, Drh. Constant Karma pada saat memberikan materi dalam rangka Hari Kesehatan Nasional [HKN] di Aula KNPI Papua beberapa waktu lalu. STHP yang melibatkan 6,305 responden di tanah Papua maupun Papua Barat telah berhasil mewawancarai 6.223 responden atau sekitar 98,7 persen tentang perilaku seksualnya serta bersedia diambil darahnya untuk pengujian virus HIV atau tes HIV.

Dari 6.223 responden ini, 3114 berjenis kelamin pria, sedangkan sisanya yaitu 3.109 adalah wanita. Sesuai dengan data yang ada diketahui bahwa sekitar 5 persen penduduk etnis Papua telah disirkumsisi(disunat) dibandingkan penduduk etnis non Papua dari warga Papua yang tinggal di kota. Hasil penelitian tersebut telah menyimpulkan bahwa sirkumsisi secara bio medis pada pria bisa mengurangi infeksi HIV hingga 60 persen.

Suatu cara baru untuk melindungi diri terhadap HIV. Oleh karean itu, dianjurkan untuk melakukan sirkumsisi. Saat ini sirkumsisi dilakukan selain untuk syarat-syarat suatu adat atau agama, sirkumsisi sangat bermanfaat bagi kesehatan, program sirkumsisi dapat menyelamatkan 3 juta jiwa dalam waktu dua puluh tahun ke depan.[cr-59]

Introduction

Franciscans International, a non-governmental organization in General Consultative
Status with the Economic and Social Council (ECOSOC), together with other
NGOs in Special Consultative Status with ECOSOC, including Catholic Institute
for International Relations, Social Service Agency of the Protestant Church in
Germany, Dominicans for Justice and Peace, Forum Asia, Pax Christi International,
Pax Romana, and the World Council of Churches, in cooperation with the Central
Missionary Board Netherlands, Cordaid, Geneva for Human Rights, ICCO,
Justitia et Pax Netherlands, Kerkinactie, Office for Justice and Peace Jayapura,
Office for Justice and Peace Merauke, Office for Justice and Peace Sorong, and
United Evangelical Mission submit this written communication to the Commission
on Human Rights with regard to the human rights situation - in the areas of
both civil and political rights and economic, social and cultural rights - in the
Province of Papua, Indonesia. The content refers in particular to the last 12 months
(January 2004-January 2005).

Civil and political rights

We acknowledge the progress made by the government in facilitating the Papuan
people's right to participate in government and in free elections. Three consecutive
elections, one round of parliamentary and two rounds of presidential elections
have been successfully held in free, fair and secure conditions.

We acknowledge also the fact that more Papuans have become legislators both at
the district and provincial levels. Nonetheless, we noted in Mimika, Jayawijaya,
Manokwari and Nabire, the tendency on the part of some candidates and political
parties to use any means at their disposal to push the Regional Election
Commission (Komisi Pemilihan Umum Daerah/KPUD) to secure their seats in the
district parliaments. Their lack of success does not exonerate their behaviour. This
situation has not only led to continuing political conflict in several districts but
has also prevented the district and provincial parliaments serving the people's
interests.

In other areas, we are deeply concerned at reports from our partners of the ongoing
practice of torture, arbitrary arrest and detention and displacement reportedly
committed by the security apparatus in spite of the adoption by Indonesia
during the 60th session of the UN Commission on Human Rights of Resolutions
nos 39, 41, 55. The cases of extra-judicial killings reported in the villages of
Mariedi, Bintuni District where BP Tangguh Gas project is located, and in Mulia,
District of Puncak Jaya, also cause us deep concern. In Mariedi, five people were
shot dead by the police and two were injured and charged with treason and membership
of the Free Papua Movement (OPM). These people were in fact asking
for fair compensation for their land rights from the Djayanti timber company. In
Mulia, the situation remains unclear following the killing of a local priest, Elisa
Tabuni, by the security forces that caused displacement, fear and terror. The religious
leaders have repeatedly urged the Provincial Parliament (DPRD) to request
the Indonesian National Commission on Human Rights (KOMNAS HAM) to
conduct a thorough investigation but to date, no action has been taken.

Puncak Jaya exemplifies the gravity of the general situation. We must also emphasize
that the human rights situation in Western Wamena has not improved since
the large-scale military operation conducted two years ago.

In the last twelve months, the stigma of separatism is regularly imposed on individuals
or institutions that the security forces consider to be suspicious. The judicial
system has proved its inability to convene fair trials owing to the pervasive
influence of the security apparatus. This was illustrated by the trials of the suspects
of the Wamena case and the Bolakme case where the court tried and sentenced
the suspects to the fullest extent possible, despite weak evidence and irregularities
during the trial.

Human rights defenders in Papua are also under threat. The Institute for Human
Rights and Advocacy (ELSHAM), Aliansi Demokrasi Papua (ALDP), Triton
Foundation and the Office for Justice and Peace Sorong are among those who have
been criminalized or arbitrarily arrested and detained due to their work to protect
and promote human rights in different parts of Papua.

From the many reported human rights cases, to date it is only the Abepura case
of 2000 which has been brought to the Permanent Human Rights Court in
Makassar, having been pending for more than three years in the Attorney General's
office. Whilst this is progress, it should be noted that the Attorney General
brought only two suspects to trial, whereas Komnas Ham had listed 25 suspects
in its investigation. Moreover, during the legal proceedings, the panel of judges
dismissed the victims' claim for compensation arguing that such a claim is not
regulated by Law 26/2000 of the Human Rights Court. Therefore, despite
Indonesian support to CHR Resolution 2004/33, we are worried that this court
runs the risk of perpetuating what appears to be an unbreakable cycle of impunity
in Indonesia. We base our concerns upon the fact that ad hoc human rights tribunals
(Tanjung Priok and Timor Leste) eventually acquitted the key perpetrators.
Without strong political will on the part of the new government, the dossiers
of Wasior (13 June, 2001) and Wamena (4 April, 2003), the result of the Komnas
Ham investigation which has been submitted to the Attorney General for prosecution,
seem likely to meet a similar fate.

Economic, social and cultural rights

While we acknowledge the progress made by the new democratically-elected government
in establishing the branch office of Komnas Ham in Papua on 10 January
2005 and the Majelis Rakyat Papua, in fulfillment of the provisions of the Special
Autonomy Law for Papua (Government Regulation 54/2004), the following needs
also to be borne in mind.

Despite the Constitutional Court Decision No. 018/PUU-I/2003 of 11 November,
2004, the conflict of the division of the province continues to exist since the Court
annulled the legal basis of Western Irian Jaya but at the same time recognized
the existence of this particular province along with the Province of Papua. This
confusion around the implementation of the Special Autonomy Law remains unresolved
since the government regulation 54/2004 on the Papuan People's Council
(Majelis Rakyat Papua/MRP) stipulates that the MRP, the provincial government
and the provincial parliament have to solve the problem in conjunction with the
central government. It does not appear that the central government wants to deal
with the problem.

In spite of the existence of the Special Autonomy Law, Papua remains ranked the
second lowest in the Indonesian Human Development Index of 2004. This is
despite its Gross Regional Domestic Product (GRDP) being ranked the third
highest in Indonesia based upon income from the trading of our rich natural
resources. This situation is no different to the one Papua faced in 1999 prior to
the implementation of the Special Autonomy Law. Among 26 districts and two
municipalities in Papua, Jayawijaya ranks the lowest of all in terms of HDI index
in Papua as well as in the whole of Indonesia. Our partners report that the public
service sector in Jayawijaya is collapsing: specialist doctors have left the city;
public servants, teachers, and local parliamentarians have been on strike in protest
at unpaid wages; and even the business community held a protest to draw attention
to the unpaid debt of the district government. In spite of mass protests in
Wamena calling for justice and appropriate action to remedy the declining situation,
the government's neglect has persisted.

Given the low rank of HDI, the 2004 UNDP report clearly identifies that available
income is not adequately invested in public services. Our partners are asking
for explanations for this severe neglect. The government admits that corruption is
a major problem in Indonesia and it is part of the new government's commitment
to combat corruption. However, action undertaken to investigate such allegations
(for example, corruption at the provincial level of Papua, in the Provincial Parliament
of Papua and in the District office of Jayawijaya) is slow in coming.

In relation to the revenues generated from natural resources, we note that the rights
of indigenous peoples to benefit from the income secured are often violated. Conflict
between the indigenous peoples and the business sector is perpetuated by the nonexistence
of a legal framework to protect the indigenous people's entitlements. In
practice, while the business sector appeals to state law, the indigenous peoples rely
on customary law. This mismatch frequently leads to human rights violations.
Examples are cases in Mariedi-Bintuni (2004) and Assue-Mappi (2004).
It is also common that the business development of these regions leads to the
encouragement of prostitution and growing cases of trafficking in human beings,
especially women and children. This in turn feeds the rapid spread of the HIV/AIDS
pandemic in Papua. A related social problem is the growth of alcoholism that in
turn significantly impacts on the number of cases of violence against women and
children, as well as declining standards of health in general. This situation remains
neglected by the government.

We believe this to be a corrosive and degenerative process that is gradually but
systematically destroying an entire people. There is an urgent need for the government
to put in place locally legal mechanisms, which can guarantee the economic,
social and cultural rights of Papuans. Signing and ratifying without delay
the International Covenant on Economic, Social and Cultural Rights, as well as
the International Covenant on Civil and Political Rights, would be a welcome
development in remedying this egregious situation. This would go some way to
beginning the implementation of the Special Autonomy Law 21 of 2001.

Promoting Peace

Our partners in Papua remain passionately committed to building Papua as "a
land of peace - free from violence, oppression and grief". They acknowledge statements
made by the government and security apparatus stating their willingness
to participate in peace activities such as the commemoration day of 5 February.
They are calling upon State bodies systematically to address the social injustices
and human rights violations of both civil and political, as well as economic, social
and cultural rights.

As non-governmental organizations with partners in Papua, we call upon the
Commission on Human Rights:

1. To urge the Indonesian government to apply a rights-based approach to
development in implementing the Special Autonomy Law;
2. To urge the Indonesian government to protect and respect the rights of
indigenous peoples in Papua;
3. To grant necessary support to the Indonesian government to promote peace
and solve the conflict with recourse to the mechanisms provided by the
Special Autonomy Law;
4. To grant the necessary support to the Indonesian government to uphold
the rule of law, so as to combat both impunity and rampant corruption;
5. To urge the new democratically-elected government to sign and ratify all
key international human rights treaties, especially the two international
covenants on Economic, Social and Cultural rights and Civil and Political
rights;
6. To urge the Indonesian government to fully cooperate in the implementation
of the Special Procedures, by inviting and providing unrestricted
access to places, individuals and communities in Papua and all other parts
of Indonesia to the thematic mechanisms, in particular to those that have
repeatedly requested invitations, but have so far not received permission
to visit, including the Special Rapporteur on torture, Special Representative
of the Secretary General on human rights defenders, and Special Rapporteur
on violence against women, its causes and consequences.

Lembaga Adat Bantah Terima Dana Besi Bekas

TIMIKA [PAPOS]- Lembaga Musyawarah Adat Suku Kamoro (Lemasko) di Mimika, Papua, membantah menerima dana pengelolaan besi bekas PT Freeport Indonesia.

"Kami sampaikan kepada seluruh masyarakat Kamoro bahwa isu itu tidak benar. Lemasko tidak pernah menerima uang dari PT Freeport maupun pengelola besi bekas," kata Ketua Lemasko Laurentius Paterpauw di Timika, Rabu.

Ia mengatakan, pengelolaan besi bekas PT Freeport Indonesia ditangani oleh PT Putra Otomona pimpinan Georgerius Okoware selama tiga tahun terakhir dan hingga kini belum ada satu sen pun dari kegiatan itu yang disetor ke Lemasko.

Menurut Paterpauw, sesuai perjanjian dengan PT Freeport Indonesia, pengelolaan besi bekas kegiatan tambang dilakukan oleh Lembaga Musyawarah Adat Suku Amungme dan Lembaga Musyawarah Adat Suku Kamoro.

Sejak 2007 hingga akhir tahun ini, katanya, pengelolaan besi bekas menjadi jatah Lemasko dan perusahaan yang ditunjuk untuk melakukan hal itu yakni PT Putra Otomona.

Selama kurun waktu tiga tahun itu PT Putra Otomona akan mengelola 15 ribu ton besi bekas dimana hingga September 2010 telah dikapalkan sebanyak 8.001 ton besi bekas ke Jakarta. Dari aktivitas itu, katanya, pihak PT Putra Otomona seharusnya memberikan kontribusi ke Lemasko sebesar Rp5 miliar."Kami sudah melakukan berbagai upaya persuasif dengan pihak PT Putra Otomona, namun hingga sekarang tidak ada tanggapan positif. Jika tidak ada tanggapan baik, Lemasko siap tempuh jalur hukum," ancam Paterpauw.

Ia menambahkan, dana hasil pengelolaan besi bekas PT Freeport merupakan hak seluruh masyarakat suku Kamoro, bukan hanya dinikmati oleh sekelompok orang-orang tertentu.

Paterpauw menegaskan, sisa besi bekas sebanyak 5.000 ton akan dikelola sendiri oleh Lemasko untuk kepentingan seluruh masyarakat suku Kamoro yang bermukim di wilayah pesisir selatan Mimika mulai dari Potowayburu yang berbatasan dengan Kabupaten Kaimana hingga Otakwa yang berbatasan dengan Kabupaten Asmat.

Besi bekas tambang Freeport selama ini menjadi rebutan banyak pihak di Timika bahkan melibatkan para pejabat teras di Jakarta karena harganya yang cukup menggiurkan dari kisaran Rp1.200 per kilo gram.[bel/ant]
